Introduction

1.1       The Local Development Scheme (LDS) sets out the key planning policy documents we will be producing over the next five years. This document is the first Local Development Scheme to be prepared in relation to the new Local Plan for North Yorkshire Council.

1.2     In terms of content there are particular requirements set out in the Planning and Compulsory Purchase Act 2004, Section 15(2) as amended. This specifies that the Local Development Scheme should include:

·         the local development documents which are to be development plan documents;

·         the subject matter and geographical area to which each development plan document is to relate;

·         which development plan documents (if any) are to be prepared jointly with one or more other local planning authorities;

·         any matter or area in respect of which the authority have agreed (or propose to agree) to the constitution of a joint committee under section 29;

·         the timetable for the preparation and revision of the development plan documents;

·         such other matters as are prescribed.

1.3      This Local Development Scheme was brought into effect from 7th February 2024 by resolution of the Council.

1.4      Copies of the Local Development Scheme are available for inspection on the North Yorkshire Council website.

1.5      The document will be revised as appropriate to reflect changes to plan preparation schedules and any revisions published on the Council’s website.


 

The proposed North Yorkshire Council Local Plan

2.1       The Local Government (Structural Changes) (Transitional Arrangements) (No.2) Regulations 2008 (as amended) requires that a single tier council adopts a local development document under section 23 of the 2004 Planning & Compulsory Purchase Act to apply to the whole of its area within a period of five years starting with the date of re-organisation. This Local Development Scheme sets out the timescales for the preparation of the new Local Plan for North Yorkshire Council which formed on 1st April 2023.

2.2       Existing local plans for the former district and county areas will remain in place until the new local plan for North Yorkshire is adopted.  Work is also continuing on two other Development Plan Documents that have reached and advanced stage; namely the Maltkiln New Settlement Development Plan Document and the Selby Local Plan.  This Local Development Scheme also sets out the timescales for the completion of these documents.

2.3       The adopted Local Plan, together with any Neighbourhood Plans that are ‘made’ will be the Development Plan for North Yorkshire and its policies will form the basis for planning decisions in the borough. The Local Plan will exclude the areas of North Yorkshire which fall within the boundaries of the North York Moors and Yorkshire Dales National Parks, who will remain the Local Planning Authorities for these geographies.

2.4       The Local Plan will be supported by a policies map which shows how policies will apply across the area.

3.4     Community Infrastructure Levy is in place for the following former Council areas

3.5       The Community Infrastructure Levy will be reviewed in line with the latest national guidance alongside the preparation of the Local Plan for North Yorkshire Council.

3.6       A number of Supplementary Planning Documents have been adopted by the District Authorities which provide further guidance to support the implementation of planning policies. Statement of Community Involvement

3.7       A new Statement of Community Involvement for North Yorkshire is being prepared which sets out how those people and organisations with an interest in development in the area can be involved in the consideration of planning applications, the preparation of planning policy documents and in planning enforcement matters in the North Yorkshire Local Planning Authority Area.

Monitoring

3.8       Until the new Local Plan for North Yorkshire is adopted, Authority Monitoring Reports will be produced on the geographical basis of the former District and County Councils on an annual basis. The Authority Monitoring Reports provide a review on the implementation of Development Plans and progress towards their completion in addition to assessing the effectiveness of policies.
